CMF sanctions Private Investment Fund Managers and General Fund Managers for breaching ongoing information duties

March 1, 2024 - The Board of the Financial Market Commission (CMF) censured 20 Private Investment Fund Managers and two General Fund Managers for breaching their ongoing information duties regarding private investment funds.

Per Exempt Resolution No. 2,004, these managers infringed the requirements set forth in General Rule No. 364 and/or General Rule No. 475 by not submitting their quarterly financial reports in due time. Such data allows the Commission to have relevant information on private investment funds, their participants, and worth of the funds' assets and liabilities. This aims to determine whether said entities comply with conditions stated in the regulations for private investment funds supervised by the CMF.

Furthermore, the CMF censured Sigma Administradora General de Fondos S.A. for breaching ongoing information duties stated in General Rule No. 431 and General Rule No. 30 of 1989. According to these regulations, General Fund Managers are to submit their annual financial statements within 90 calendar days after the closing date of the corresponding period. However, per Exempt Resolution No. 2,003, Sigma failed to present its annual financial statements as of December 31, 2022 in the allotted timeframe (i.e. until March 31, 2023), instead sending them to the CMF on April 19, 2023.
